STANDARD TERMS AND CONDITIONS OF SALE


Reservation Policy

  1. The client explicitly waives its own standard terms and conditions, even if these were drawn up after these standard terms and conditions of sale. In order to be valid, any derogation must be expressly agreed to in advance in writing.
  2. Our invoices are payable within 21 working days, unless another payment timeframe is indicated on either the invoice or the order. In the event of non-payment by the due date, SMTouring.com reserves the right to request a fixed interest payment amounting to 10% of the sum remaining due. SMTouring.com will be authorized to suspend any provision of services without prior warning in the event of late payment.
  3. If a payment is still outstanding more than sixty (60) days after the due payment date, SMTouring.com reserves the right to call on the services of a debt recovery company. All legal expenses will be payable by the client.
  4. Certain countries apply withholding at source on the amount of invoices, in accordance with their internal legislation. Any withholding at source will be paid by the client to the tax authorities. Under no circumstances can SMTouring.com become involved in costs related to a country's legislation. The amount of the invoice will therefore be due to SMTouring.com in its entirety and does not include any costs relating to the legislation of the country in which the client is located.
  5. SMTouring.com undertakes to do its best to supply performant services in due time in accordance with the agreed timeframes. However, none of its obligations can be considered as being an obligation to achieve results. SMTouring.com cannot under any circumstances, be required by the client to appear as a third party in the context of any claim for damages filed against the client by an end consumer.
  6. In order for it to be admissible, SMTouring.com must be notified of any claim by means of a letter sent by recorded delivery to its registered office within 8 days of the delivery of the goods or the provision of the services.
  7. All our contractual relations will be governed exclusively by law.


Payment Policy

  • The total amount of your reservation will be charged immediately to your credit card and will appear on your statement. We accept the following credit cards: Visa, MasterCard, and American Express. If you do not have any of these cards, you can make a bank transfer.   • The rates published on our site are quoted in US dollars unless otherwise stated. Charges may be made in Mexican pesos, and in the case of other currencies, the transaction amount will be converted to US dollars according to the exchange rate in effect on the date of the transaction. Please note that the amount appearing on your credit card payment receipt may vary by up to three percent due to fluctuations in the international exchange rate. SMTouring.com is not responsible for such fluctuations, and by accepting these policies, you acknowledge and accept this possible variation and the corresponding charges in US dollars or Mexican pesos.


Cancellation and Refund Policy

  • All cancellation requests must be submitted in writing to our Customer Service Department, including your reservation number.
  • To cancel your reservation, please send an email to cancel@smtouring.com with your reservation number and the reason for the cancellation at least 48 hours before your pickup time.
  • Changes to flight numbers or services can only be made at least 48 hours in advance.
  • We do not offer refunds on the day of your trip. Please coordinate directly with the airline for any protection or compensation.


Invoicing Policy

  • If you need an invoice for your transportation service, please attach the following documentation to the email addressed to facturas@smtouring.com:
  • A legible photo of the receipt.
  • Payment method (for example, credit card) and proof of payment.
  • Tax situation certificate (CSF) in PDF format.
  • You must send your invoice request within the month in which the service was provided. We will not be able to process your invoice if the information is incomplete or sent after the deadline.


Liability Disclaimer

SMTouring.com acts as an intermediary between clients and the suppliers of goods and services promoted on the website. SMTouring.com facilitates business negotiations within its standards of quality and service, including, but not limited to, ground transportation and related tourist activities such as tours and excursions. We work exclusively with qualified and highly reputable suppliers. However, SMTouring.com cannot assume responsibility for the acts or omissions of these suppliers, as we do not have control over their legal or personal relationships, equipment, operations, or properties.

SMTouring.com states the following:

  1. The photos shown on the website are representative and may not exactly match the service or experience at the time of arrival.
  2. The descriptions of travel services are updated to the best of our knowledge, but may differ slightly at the time of arrival.
  3. SMTouring.com reserves the right to deny service to any customer at any time.
  4. Claims or written notices against SMTouring.com must be sent to claims@smtouring.com within fourteen (14) days following the trip.

SMTouring.com is not responsible for any claims, costs, or expenses arising from:

  1. Personal injuries or injuries to third parties, accidents or fatalities; loss or damage to personal property; or dissatisfaction resulting from acts or omissions of any person other than SMTouring.com or its employees.
  2. Illnesses, thefts, labor disputes, mechanical failures, quarantines, government actions, weather conditions, excessive vehicular traffic, road repairs, accidents, or other causes beyond our control.
  3. The customer's failure to obtain the required documentation for their trip (e.g., passports, visas, certificates), which may result in the denial of services without a refund.
  4. The customer's failure to follow instructions, including airport departure times, service schedules, or coupon redemption policies.
  5. Cancellation or changes in travel services due to circumstances beyond our control, such as weather, natural disasters, or acts of terrorism. While we will attempt to replace services with comparable options, no full refunds will be issued for cancellations or interruptions caused by these events. SMTouring.com reserves the right to withhold up to 10% of the total reservation amount for administrative fees.

Despite close communication with suppliers, errors in pricing or outdated information can occur. SMTouring.com verifies all rates at the time of booking. If the correct price is lower, the reduced rate will apply. If it is higher, your Travel Consultant will contact you with the updated amount. You can choose to accept the updated price or cancel the reservation. SMTouring.com and its suppliers are not responsible for any inconvenience caused by such cancellations.
